I don't think its food poisoning...as food poisoning will usually only last 18-36 hours after you've eaten something bad. My wife and I had food poisoning a few years ago after eating crab legs and it is definitely something I don't ever want to go through again. From 10 PM until 6 AM the next day we both spent a lot of time hanging our heads over trash cans or the toilet...to this day neither of us can stand the idea of eating crab legs.
The restaurant isn't liable for you getting sick. What could you possibly sue for? The cost of the meal you hacked back up? Time spent in the restroom? It may not be a bad idea to inform them that the food you ate had either expired or was improperly cooked....that is assuming it had anything to do with the food.
It could have been something so simple as germs on a door handle that you both touched.
