I am not sure if a handled the situation correctly and I wanted some feedback. About two weeks ago, i purchased a sky caddie from the internet (official site). Last week i received the sky caddie and the package looked new. However, during the registration process, I discover that there is already an active account. I turned on the sky caddie, and the previous owners telephone number is stored in memory. I called the number (to make sure it had not been lost or stolen) and the gentleman states that he purchased the sky caddie several months ago. He added that he used the product several times, but returned it to golfsmith because he upgraded to a sg3.
As such, I called the customer service number at skygolf. After explaining my situation, the rep said that I should return the product and a new unit would be sent to me. I told the rep that I didn't want to go through the hassle (repackaging-going to the post office) and i asked if i could purchase the unit as used and receive a discount. The rep said i needed to talk to a supervisor, but considering it being Saturday, a supervisor would call me on Monday (I left my number).
Nobody calls me on Monday, Tuesday, Wed (holiday), and Thursday. Thursday afternoon, a finally get a hold of a rep after waiting on hold for 20 minutes. I explained to the rep that I purchased a new skycaddie, but I received a used unit instead. Initially, the rep tried telling me that the unit must have come from a pro shop and it had already been pre programmed with courses. However, when I told him that another owners name and number was already programed in the unit, he could not offer an explanation. After speaking with his manager, he stated that the best they could do was to send me a new unit.
I declined the offer and told him that I wanted my money back because i believed their actions were fraudulent by trying to sell me a used product. In addition, i told him that i did not believe i should be inconvenienced due to their mistake/fraud.
Am i wrong in not returning the used unit for a new one?
if you don't like the unit, send it back, and get a refund. if you do like it, but want a new one, send it back and get a replacement. either way you need to return the unit. you're not giving the shop a fair shake, as they may have shipped the product by mistake. of course they need to pay for shipping and handling.
Whether they intended to or not, they committed a type of fraud.
You can't put a product in a box that does not match the box. That is misrepresentation.
They cannot charge you an advertised price for a new item and then switch it for a used one for the same price. That's also illegal.
But they said return the one you have and they would send a new one. They don't sell used ones, at least they don't list them as being for sale, which is what you are asking for.
You won't win in a BBB negotiation because they offered to make it right. You seem to want good as new for less money. Admirable, but it's not what they are selling.
Could they afford to knock off 10 percent to resolve it? yes.
Would a DA take an interest in going after them for misrepresentation/bait and switch/fraud? Maybe, but probably not.
Send it back and ask them for a 25 percent off coupon on your next purchase, to be enclosed with the new unit.
yes, I do plan on sending the unit back and getting a refund. The rep also said they sent me an email with an address and ram number to send the unit back, but i have not received said information. It appears that i need to make another call and wait on hold
Yes, they are definately in the wrong regardless of wether it was a mistake. I wonder if anyone out there has had similiar problems with the company?? I'm led to believe it is a pretty good product.
It might be just a one of mistake but I feel if you want your money back then they should oblige without question.
